O-1 visa for founders and creators: requirements and strategy in 2026
No lottery, no cap and reported approval rates above 90%. Why O-1 is the go-to work visa for founders and creators — and what it takes.
O-1 is a temporary work visa for people with extraordinary ability or achievement. Unlike H-1B, it has no lottery and no annual cap. Reported USCIS data showed O-1 approval rates above 90% in the first half of fiscal year 2026.
O-1A for founders
Founders typically qualify through criteria such as press coverage, judging (accelerators, competitions), original contributions, a critical role at a distinguished company, and high compensation. Your own U.S. company can be the petitioner if it is a genuine employer.
O-1B for creators
Artists, filmmakers and content creators show distinction through reviews, press, credits, awards and commercial success. Follower counts alone rarely carry a case — engagements with recognized brands and media do.
Who can petition
- A U.S. employer offering specific work.
- Your own U.S. company, with proper corporate structure.
- An agent, which can combine several engagements in one petition.
From O-1 to a green card
Many O-1 holders later file EB-1A or EB-2 NIW using overlapping evidence. Building the O-1 file with that next step in mind saves time later.
