EB-1A requirements: the 10 criteria explained (2026 guide)

Meeting three criteria is only the start. Here is how officers actually read an EB-1A petition — and how to build one that holds up.

EB-1A is a self-petitioned green card for people with extraordinary ability in sciences, arts, education, business or athletics. No employer or job offer is required. The regulation lists ten types of evidence; you must meet at least three — or show a major internationally recognized award.

The 10 criteria

  • Nationally or internationally recognized prizes or awards for excellence.
  • Membership in associations that require outstanding achievement.
  • Published material about you in professional or major media.
  • Judging the work of others in your field.
  • Original contributions of major significance.
  • Authorship of scholarly articles.
  • Display of your work at artistic exhibitions or showcases.
  • A leading or critical role for distinguished organizations.
  • High salary or remuneration compared with others in the field.
  • Commercial success in the performing arts.

Step two: the final merits review

Since the Kazarian decision, USCIS applies a two-step analysis. After counting criteria, the officer asks whether the evidence as a whole shows sustained national or international acclaim and that you are among the small percentage at the top of your field. This is where many petitions fail.

What changed in 2026

Reported USCIS data showed EB-1A approval rates around 47% in Q1 and 42% in Q2 of fiscal year 2026. Combined with the August 2026 policy allowing denials without an RFE, weak or incomplete petitions are far riskier than before.

What strong evidence looks like

  • Context for every exhibit: circulation of a publication, selectivity of an award, ranking of an organization.
  • Independent recommendation letters that describe specific contributions and their impact.
  • A clear narrative tying the criteria together into one story of sustained acclaim.
