Green card through marriage to a U.S. citizen: step-by-step (2026)

Spouses of U.S. citizens skip the line — but 2026 rules on discretion and public charge mean preparation matters more than ever.

Marriage to a U.S. citizen is one of the most direct paths to a green card. Spouses of citizens are “immediate relatives,” so there is no annual quota and no waiting for a priority date.

Step by step

  • The citizen spouse files Form I-130 to prove the relationship.
  • If you are in the U.S. and eligible, file Form I-485 at the same time, plus work and travel permits.
  • If you are abroad, the case moves to the National Visa Center and a consular interview.
  • Biometrics, then an interview — often with both spouses present.

Proving a real relationship

  • Joint lease or mortgage, shared bills and bank accounts.
  • Photos over time, travel records, communication history.
  • Affidavits from friends and family who know you as a couple.

What changed in 2026

USCIS now stresses that adjustment of status is discretionary, and a new public charge approach applies to filings from September 18, 2026. Past overstays or unauthorized work weigh more than before, and the sponsor’s Affidavit of Support deserves careful preparation.

Conditional residence

If you have been married less than two years when the green card is approved, you receive a two-year conditional card and must file to remove conditions before it expires.
